Terms of Service

Welcome to Arca Compliance. These Terms of Service ("Terms") govern your access to and use of our kitchen diary platform (the "Service").

By signing up for or using the Service, either directly or via a partner (e.g., Food Safety Logic), you agree to be bound by these Terms.

1. Who We Are

Arca Compliance is a trading name of Arca Compliance, a company registered in England & Wales at:
6 Highfield Road, Kidderminster, DY10 2TL

2. Description of Service

The Service provides digital tools for food businesses to log and manage kitchen compliance activities, including:

  • Opening and closing checks
  • Cleaning records
  • Delivery temperature logging
  • Fridge and freezer checks
  • Scale and probe calibrations

The Service is subscription-based, priced per kitchen, with pricing tiers starting from five kitchens.

3. Account Creation and Access

  • Customers may sign up directly with Arca Compliance or via a reselling partner (e.g., Food Safety Logic).
  • Accounts must not be shared. You are responsible for all activity under your login credentials.
  • If you signed up through a partner, you cannot switch to a direct subscription. You must manage your subscription through a partner.
  • You may switch between partners, subject to partner availability and agreement.
  • If your partner ceases to resell the Service, you must transfer to another partner to continue service.

4. Partner Responsibilities

  • Partners resell the Service and act as the primary point of contact for their customers.
  • Partners own the customer relationship and act as Data Controllers under applicable laws.
  • Partners can access their customers' data but cannot access data of direct customers or customers of other partners.
  • Billing is managed by the partner. Customers pay their partner directly unless subscribed directly through Arca Compliance.

5. User Conduct

  • Users must not use the Service for fraudulent or malicious purposes.
  • Users may not falsify logs or tamper with system functionality.
  • Accounts may be suspended or terminated for misuse or violation of these Terms or our Acceptable Use Policy.

6. Service Availability & Liability

  • The Service is provided “as-is” without warranties of any kind.
  • We do not guarantee uptime or defect-free performance.
  • We do not impose a specific liability cap but disclaim all implied warranties.

7. Data & Privacy

  • Data is stored within the UK.
  • A separate Privacy Policy explains how we collect and use your data.
  • The system includes audit trails for compliance purposes.
  • You may request data export or deletion.
  • Data is retained for 90 days after cancellation or termination before being permanently deleted.

8. Cancellation & Termination

  • You may cancel your subscription at any time.
  • No refunds are provided for any reason, including unused service periods.
  • Upon termination, data is retained for 90 days, after which it will be deleted.

9. Branding & White Labelling

  • Partners may white-label the Service with their own branding.
  • Brand appearance may vary depending on your selected partner.

10. Governing Law

These Terms are governed by the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to Terms

We may revise these Terms from time to time. We will notify users of any material changes. Continued use of the Service after changes take effect constitutes your agreement to the new Terms.
